1. Scope

1.1 These Terms of Service apply to all orders placed by consumers through the online shop nexaluvor.com. The shop is operated by:

(hereinafter "Nexaluvor", "we", "us" or "our")

1.2 A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

1.3 Any terms and conditions of the customer that deviate from these Terms of Service do not apply unless we have expressly agreed to them in writing.

2. Conclusion of the Contract

2.1 The presentation of products in our online shop does not constitute a legally binding offer, but an invitation for you to place an order.

2.2 By clicking the button "Buy now" or a button with similar wording, you submit a binding offer to purchase the products in your shopping cart. Before submitting your order, you can review and correct all entries at any time.

2.3 After receiving your order, we will send you an automatic email confirming receipt of your order. This confirmation does not yet constitute acceptance of your offer. The contract is concluded when we accept your order by sending a separate order confirmation or a shipping confirmation by email, or by dispatching the goods.

2.4 The contract language is English. We store the contract text and send you the order details and these Terms of Service by email. You can also view the current Terms of Service on our website at any time.

3. Prices and Shipping Costs

3.1 All prices stated in our shop are final prices in euros and include the statutory German value added tax.

3.2 We deliver within Germany only. You can choose between free standard shipping and insured express shipping for 2.95 EUR. Details can be found in our Shipping Policy.

4. Payment

4.1 The available payment methods are shown during checkout. Depending on the payment method, payment may be processed by an external payment provider, whose terms also apply.

4.2 Payment is due immediately upon conclusion of the contract unless a later due date has been agreed, for example when paying by invoice or in instalments through a payment provider.

5. Delivery

5.1 Delivery is made to the address you provide. Delivery times are stated on the respective product page and in our Shipping Policy.

5.2 If a product you ordered is unexpectedly not available, we will inform you without delay and refund any payments already made.

6. Retention of Title

The goods remain our property until full payment has been made.

7. Right of Withdrawal

As a consumer, you have a statutory right of withdrawal. Full details, including the model withdrawal form, can be found in our Returns and Refunds policy.

8. Warranty

8.1 The statutory warranty rights apply to all products purchased from us.

8.2 If you receive goods with obvious transport damage, please let us know as soon as possible. Failing to do so does not affect your statutory rights, but it helps us make claims against the carrier.

9. Liability

9.1 We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, and where we have given a guarantee.

9.2 In the case of slight negligence, we are only liable for the breach of essential contractual obligations, meaning obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely. In this case, our liability is limited to the foreseeable damage typical for this type of contract.

9.3 The above limitations of liability also apply to our legal representatives and vicarious agents.

10. Proper Use of Products

Please use our products as intended and follow the product descriptions, size information and care instructions. Our pet supplies are not a substitute for veterinary advice. If you have concerns about the health of your pet, please consult a veterinarian.

11. Use of the Website

11.1 The content of our website, including texts, images and graphics, is protected by copyright. Any use without our prior written consent is not permitted.

11.2 You may not use our website for unlawful purposes, transmit malicious code, or interfere with the security or operation of the website.

12. Dispute Resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board. If you have a complaint, please contact us directly at info@nexaluvor.com.

13. Governing Law

13.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law only applies insofar as it does not deprive you of the protection granted by mandatory provisions of the law of the country in which you have your habitual residence.

13.2 Should any provision of these Terms of Service be or become invalid, the validity of the remaining provisions shall not be affected.
